In Nevada there are limits to what an attorney can collect as a contingency fee in a medical malpractice case. An attorney cannot collect a medical malpractice contingency fee greater than 25% for the portion of a settlement or verdict that exceeds $100,000. Furthermore, an attorney cannot collect a medical malpractice contingency fee greater than 15% for the portion of a settlement or verdict that exceeds $600,000.
Thus if your attorney took a flat 40%, or even 33%, of your settlement or verdict amount, then you may have been overcharged.
As some of these attorneys are becoming aware that I am advocating the rights of their former clients, they may attempt to return a small portion of the money they overcharged in exchange for the former client signing a release. Please call my office before accepting any money and signing a release. Even if you have signed such a release, please call my office as it may not be a valid release. Furthermore, such an unscrupulous act by the attorney may open the door to a fraud claim and punitive damages against the attorney.
